Users

Access to and/or use of this BlackfishID portal confers the status of USER, who accepts, from such access and/or use, these General Terms of Use. These terms shall apply regardless of the General Terms and Conditions of Contracting that, where applicable, may be mandatory.

Use of the Portal

blackfishid.com provides access to a wide range of information, services, programmes or data (hereinafter, “the content”) on the Internet belonging to BlackfishID or its licensors, to which the USER may have access. The USER assumes responsibility for the use of the portal. Such responsibility extends to any registration that may be necessary in order to access certain services or content. In such registration, the USER shall be responsible for providing truthful and lawful information. As a result of this registration, the USER may be provided with a password for which they shall be responsible, undertaking to use it diligently and confidentially.

The USER undertakes to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) offered by BlackfishID through its portal and, by way of example but not limited to, not to use them to:

(i) engage in unlawful, illegal or contrary to good faith and public order activities;

(ii) disseminate content or propaganda of a racist, xenophobic, illegal pornographic nature or that violates human rights;

(iii) cause damage to the physical and logical systems of BlackfishID, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical system capable of causing the aforementioned damage;

(iv) attempt to access and, where appropriate, use other users' email accounts and modify or manipulate their messages.

BlackfishID reserves the right to remove any comments and contributions that violate respect for human dignity, are discriminatory, xenophobic, racist, pornographic or, in its opinion, are not suitable for publication. In any event, BlackfishID shall not be responsible for opinions expressed by users through forums, chats or other participation tools.

Data Protection

BlackfishID complies with the guidelines of Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, as well as Royal Decree 1720/2007 of 21 December, which approves the implementing regulation of the Organic Law and other regulations in force at any given time, and ensures proper use and processing of users' personal data.

For this purpose, together with each personal data collection form in the services that the user may request from support@blackfishid.com, the user will be informed of the existence and acceptance of the specific conditions for the processing of their data in each case, informing them of the responsibility for the file created, the address of the controller, the possibility of exercising their rights of access, rectification, cancellation or objection, the purpose of processing and, where applicable, the communication of data to third parties. Likewise, BlackfishID informs that it complies with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and will at all times request the user's consent for the processing of their email address for commercial purposes.

Intellectual and Industrial Property

BlackfishID, either itself or as assignee, owns all intellectual and industrial property rights in its website, as well as in the elements contained therein (by way of example: images, sound, audio, video, software or text; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by BlackfishID or its licensors. All rights reserved.

Pursuant to Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website, for commercial purposes, on any medium and by any technical means, without the authorisation of BlackfishID, is expressly prohibited. The USER undertakes to respect the Intellectual and Industrial Property rights owned by BlackfishID. The USER may view the elements of the portal and even print, copy and store them on the hard drive of their computer or on any other physical medium provided that this is solely and exclusively for their personal and private use. The USER must refrain from deleting, altering, circumventing or manipulating any protection device or security system installed on BlackfishID pages.

Disclaimer of Warranties and Liability

BlackfishID shall not be liable, under any circumstances, for any damages of any kind that may arise, by way of example: errors or omissions in the content, lack of availability of the portal, or the transmission of viruses or malicious or harmful programmes in the content, despite having adopted all necessary technological measures to prevent this.

Modifications

BlackfishID reserves the right to make such changes to its portal as it deems appropriate without prior notice, and may change, remove or add both the content and services provided through it and the way in which they are presented or located on its portal.

Links

In the event that blackfishid.com provides links or hyperlinks to other Internet sites, BlackfishID shall exercise no control over such sites and content. Under no circumstances shall BlackfishID assume any responsibility for the content of any link belonging to an external website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, truthfulness, validity and constitutionality of any material or information contained in such hyperlinks or other Internet sites. Likewise, the inclusion of these external connections shall not imply any type of association, merger or participation with the connected entities.

Right of Exclusion

BlackfishID reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, on its own initiative or at the request of a third party, to those users who fail to comply with these General Terms of Use.

General Provisions

BlackfishID will pursue any breach of these conditions as well as any improper use of its portal by exercising all civil and criminal actions to which it may be entitled under the law.

Amendment of these conditions and duration

BlackfishID may amend the conditions set out herein at any time, and such amendments shall be duly published as they appear here. The validity of the aforementioned conditions shall depend on their display and shall remain in force until they are amended by others duly published.

Applicable Law and Jurisdiction

The relationship between BlackfishID and the USER shall be governed by current Spanish legislation and any dispute shall be submitted to the courts and tribunals of the city of Granollers.
