Users

Access to and/or use of this BlackfishID portal attributes the status of USER, which implies acceptance of these General Conditions of Use from such access and/or use. These conditions will apply independently of any General Contracting Conditions that, where applicable, must be complied with.

Use of the Portal

blackfishid.com provides access to a multitude of information, services, programs or data (hereinafter, "the contents") on the Internet belonging to BlackfishID or to its licensors to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to any registration that might be necessary to access certain services or content. In such registration, the USER will be responsible for providing truthful and lawful information. As a result of such registration, the USER may be provided with a password for which they will be responsible, committing to make diligent and confidential use of it.

The USER agrees to make proper use of the contents and services (such as chat services, discussion forums or newsgroups) that BlackfishID offers through its portal and, by way of example but not limitation, agrees not to use them for:

(i) engaging in illicit, illegal activities or those contrary to good faith and public order;

(ii) disseminating content or propaganda that is racist, xenophobic, pornographic-illegal or contrary to human rights;

(iii) causing damage to the physical and logical systems of BlackfishID, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that are capable of causing the aforementioned damages;

(iv) attempting to access and, if applicable, use the email accounts of other users and modify or manipulate their messages.

BlackfishID reserves the right to withdraw all comments and contributions that violate respect for the dignity of persons, that are discriminatory, xenophobic, racist, pornographic or that, in their view, are not suitable for publication. In any case, BlackfishID will not be responsible for the opinions expressed by users through forums, chats or other participatory tools.

Data Protection

BlackfishID complies with the guidelines of the Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights, as well as with the Royal Decree 1720/2007, of 21 December, which approves the Regulation for the development of the Organic Law and other current regulations, and ensures the correct use and treatment of the user's personal data.

To this end, alongside each form for personal data collection in the services that the user may request at support@blackfishid.com, the user will be informed of the existence and acceptance of the particular conditions for the processing of their data in each case, informing them of the responsibility for the created file, the address of the responsible party, the possibility of exercising their rights of access, rectification, cancellation or opposition, the purpose of the processing and possible data communications to third parties. Furthermore, BlackfishID informs that it complies with the Law 34/2002, of 11 July, on Services of the Information Society and Electronic Commerce, and will seek the user's consent at all times for the processing of their email for commercial purposes.

Intellectual and Industrial Property

BlackfishID, itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as of the elements contained therein (by way of example: images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by BlackfishID or its licensors. All rights reserved.

By virtue of the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including its mode of making available, of the entire or part of the contents of this website for commercial purposes, on any medium and by any technical means, is expressly prohibited without the authorisation of BlackfishID. The USER undertakes to respect the Intellectual and Industrial Property rights owned by BlackfishID. They may view the elements of the portal and even print, copy and store them on the hard drive of their computer or any other physical medium provided it is solely and exclusively for personal and private use. The USER must refrain from deleting, altering, bypassing or manipulating any protective device or security system that was installed on BlackfishID's pages.

Exclusion of Warranties and Liability

BlackfishID is not liable, in any case, for damages of any nature that may result, by way of example: errors or omissions in the contents, unavailability of the portal or the transmission of viruses or harmful programs in the contents, despite having taken all the necessary technological measures to prevent it.

Modifications

BlackfishID reserves the right, without prior notice, to make modifications that it deems appropriate to its portal, being able to change, remove or add both the contents and services provided through it and the way they are presented or located on its portal.

Should blackfishid.com provide links or hyperlinks to other Internet sites, BlackfishID will not exercise any control over such sites and content. In no case will BlackfishID assume responsibility for the contents of any link belonging to a third-party website, nor will it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, validity, and constitutionality of any material or information contained in such hyperlinks or other Internet sites. Similarly, the inclusion of these external connections will not imply any type of association, merger or participation with the connected entities.

Right of Exclusion

BlackfishID reserves the right to deny or withdraw access to the portal and/or services offered without prior notice, at its own request or at the request of a third party, to those users who violate these General Conditions of Use.

General

BlackfishID will pursue non-compliance with these conditions as well as any improper use of its portal by exercising all civil and criminal actions that may correspond in law.

Modification of these conditions and duration

BlackfishID may modify at any time the conditions determined herein, the same being duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will remain in force until they are modified by others duly published.

Applicable Law and Jurisdiction

The relationship between BlackfishID and the USER will be governed by the current Spanish regulations and any dispute will be submitted to the Courts and tribunals of the city of Granollers.
